These Terms of Use govern the use of the multiplayer web game Noise at noize.fun. By using the service, you agree to these terms.
1. Scope of the Service
Noise is a browser-based multiplayer game that allows users to create and join lobbies, submit text input, and exchange audio recordings during a game round. There is no entitlement to any specific feature, permanent availability, or unchanged continuation of individual game modes.
2. Requirements for Use
Using Noise requires a compatible device, a current browser, a functioning internet connection, and, for recording features, a microphone with the necessary browser permission if applicable. If you are a minor, you may only use Noise to the extent permitted under the laws that apply to you.
3. Acceptable Use
You may only use Noise lawfully and respectfully. In particular, the following is prohibited:
- uploading, recording, or distributing unlawful, abusive, discriminatory, pornographic, violent, or harmful content,
- infringing copyrights, trademarks, personality rights, or any other rights of third parties,
- using the service for spam, fraud, malware, automated bulk requests, or bypassing technical protection measures,
- disrupting lobbies, infrastructure, or other players.
4. Names, Text, Audio, and Other Content
You are solely responsible for the player names, text input, and audio recordings you provide. If you upload or record content in Noise, you confirm that you are entitled to do so.
You grant the operator of Noise, for the duration of the technical provision of the service, a simple, non-exclusive right to store your content, process it within the respective lobby, transmit it to other participants in the same lobby, and make technical copies as required to operate the game.
5. Storage and Deletion of Game Content
Lobby data, text, and audio content are stored only to the extent necessary for operating the game. Audio files may in particular be deleted when a lobby is closed or reset, when no players remain in the lobby, or at the latest after the configured end-screen timeout. There is no right to permanent storage or recovery.
6. Moderation, Restriction, and Removal of Content
The operator may remove, restrict, or block content or usage in whole or in part if there are indications of a violation of these terms, legal obligations, or third-party rights. The same applies if this is necessary for IT security, abuse prevention, or service stability.
7. Availability
Noise is provided as an online service that is continuously evolving. Maintenance, technical issues, security measures, or infrastructure problems may lead to restrictions or outages. No specific uptime or error-free operation is guaranteed.
8. Liability
The operator is fully liable in cases of intent and gross negligence, as well as for injury to life, body, or health. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage. In all other cases, liability for slightly negligent breaches of duty is excluded to the extent permitted by law. Mandatory statutory claims remain unaffected.
9. Changes to the Service and These Terms
The operator may modify, expand, or discontinue features for legitimate reasons, especially for technical, security-related, legal, or commercial reasons. These Terms of Use may be updated with future effect. Material changes should be communicated in an appropriate manner.
10. Applicable Law
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection laws of the country of your habitual residence provide otherwise.
